Terms of Service
These Terms of Service ("Terms") govern your use of thronelocal.com (the "Site") and the free Google Business Profile audit (the "Audit") offered by Elite Call Flow LLC, a New Mexico limited liability company that operates the Throne Local brand ("Throne Local," "we," "us," or "our"). By using the Site or requesting an Audit, you agree to these Terms. If you do not agree, please do not use the Site.
1. The Audit
- The Audit is offered free of charge. No purchase is required and there is no obligation to buy anything.
- We prepare the Audit from publicly available information, including Google Business Profile data and your public website. Some items require a manual review and may be discussed with you by phone.
- The Audit is provided for information only. It reflects the data available on the date it is prepared and may be incomplete or change over time.
- We may contact you by phone, text message and email about the Audit and about our services, as described in our Privacy Policy.
2. Our services
Any paid service, including Google Business Profile management, is provided only under a separate written agreement or order that states the scope, price and terms. Nothing on the Site is an offer that you can accept to create a binding contract for paid services.
3. No guarantee of results
Local search rankings and customer actions depend on many factors outside our control, including Google's algorithms and policies, competition, location and your business. We do not guarantee any ranking, position, traffic, calls, leads or revenue.
4. Your responsibilities
- The information you give us must be accurate, and you must be authorized to request an Audit for the business you enter.
- You will not misuse the Site, attempt to disrupt or gain unauthorized access to it, use automated tools to submit requests, or submit information about a business you are not authorized to represent.
5. Intellectual property
The Site, the Audit format, our logos, text and design are owned by Elite Call Flow LLC or its licensors and protected by law. You may use your own Audit report for your internal business purposes. You may not copy, resell or republish the Site or our materials without our written permission. Google, Google Maps and Google Business Profile are trademarks of Google LLC. We are not affiliated with, endorsed by or sponsored by Google.
6. Third-party services and links
The Site and Audit rely on third-party services and data, such as Google. We do not control them and are not responsible for their availability, accuracy or content.
7. Disclaimer of warranties
The Site and the Audit are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, to the fullest extent permitted by law.
8. Limitation of liability
To the fullest extent permitted by law, Elite Call Flow LLC and its members, managers, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of the Site or the Audit. Our total liability for any claim relating to the Site or the free Audit will not exceed one hundred US dollars ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
9. Indemnification
You agree to indemnify and hold harmless Elite Call Flow LLC from claims, damages and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these Terms or of any law or third-party right.
10. Governing law and disputes
These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law rules. Any dispute relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Bernalillo County, New Mexico, and you consent to their jurisdiction. Before filing a claim, you agree to contact us and try in good faith to resolve the issue informally.
11. Changes
We may change the Site, the Audit or these Terms at any time. The effective date above shows when the Terms were last updated. Continued use after a change means you accept the updated Terms.
